Contest Rules
The “Get a head start on your vacation” contest is held by La Fabrique de Matelas (hereinafter collectively: the "Contest Organizers"). It takes place in the 7 La Fabrique du matelas location, from March 1, 2022 at 00:00 E.T. until March 31, 2022 at 23:59 E.T. (hereinafter: the "Contest Period"). (hereinafter: the "Contest Period"). All references to time in these rules refer to Eastern Time.
ELIGIBILITY
This contest is open to all Quebec residents aged 18 or older. Employees, officers, directors, agents and representatives of the Contest Organizer, their affiliated, related, subsidiary and affiliated companies, their advertising and promotional agencies, partners, participating merchants, suppliers of prizes, materials and services related to this Contest or any other party directly involved in the holding of this Contest, as well as members of their immediate families (brothers, sisters, children, father, mother), their legal or common-law spouses and all persons with whom these employees, agents and representatives are domiciled, are not eligible.
HOW TO ENTER - REGISTRATION
- PURCHASE REQUIRED. Registration for the contest is made following the purchase of one or more RV mattresses in one of the 7 La Fabrique de matelas stores.
- Following the purchase of an RV mattress in one of the 7 La Fabrique de matelas stores, an "Entry Form" will be filled out and the following information will be requested: last name, first name, sales contract number, telephone number where you can be reached between 9:00 a.m. and 5:00 p.m. on weekdays.
- A person may enter the contest more than once, by purchasing more than one RV mattress.
Participants must respect the following limits, failing which the Contest Organizers reserve the right to cancel one or more of their Entry Forms:
- Only RV mattress cats designed to La Fabrique de Matelas standards are considered for this contest. Any other purchase will result in the automatic cancellation of their entry(s).
PRIZES
The following prizes are offered in the Contest:
- Grand Prizes. A total of 11 spa packages will be randomly awarded, consisting of:
- Three accesses for one person to the water circuit at Bota Bota, valued at $80 plus taxes each;
- Five packages for one person at Bota Bota including a massage and access to the water circuit, valued at $195 plus taxes each;
- Three packages for one person at Balnea including a massage and access to the baths, a value of $165 plus taxes each.
The following conditions apply to the prize(s):
Grand Prizes: Each Grand Prize is non-exchangeable and non-transferable. All expenses and fees not covered by these rules are the responsibility of the winner and/or his/her guest(s) (if any). Each Grand Prize must be accepted as awarded. If any portion of the Grand Prize is not used, in whole or in part, no compensation will be provided. In the event that all or part of the Grand Prize is delivered by mail, the Contest Organizers are not responsible for late delivery, loss or theft of the Grand Prize, including in connection with its delivery.
DRAW
On April 14, 2022 at 3:00 p.m., at the La Fabrique de matelas franchise in Saint-Jean-sur-Richelieu, a random selection of 11 entries will be made from among all the entries registered in accordance with the terms of this contest to award the prizes. The grand prizes are awarded at random to the 11 entries selected.
There is no limit to the number of prizes per person per residence.
The odds of an entrant's Entry being selected at random will depend on the number of Entries registered in accordance with this Agreement.
PRIZE CLAIM
In order to be declared a winner, the selected person must:
- have purchased one or more RV mattresses at one of the 7 La Fabrique de Matelas locations; and
- be contacted in person, by telephone by the Contest Organizers within 24 hours of the random selection. It is the responsibility of each entrant to provide a valid telephone number where he or she can be reached between 9:00 a.m. and 5:00 p.m. on weekdays during this period; and
- sign the Declaration and Release Form (hereinafter the "Declaration Form") that will be sent to him/her and return it by e-mail to the Contest Organizers no later than 2 days after receiving it.
Failure to comply with any of the conditions mentioned in these rules will result in the selected entrant's entry being null and void and a new draw for that prize will be held in accordance with these rules until an entrant is selected and declared a winner.
Following the announcement of the randomly selected winners on April 14, 2022, they will have 2 weeks following the announcement to take possession of their prize in accordance with the terms and conditions agreed upon with the Contest Organizers.
Where the prize entitles the winner to invite guests of his/her choice, the winner's guests must also complete and sign a Declaration Form. The Contest Organizer reserves the right to refuse access to the prize to any guest who does not provide the Contest Organizer with a duly completed and signed Declaration Form prior to the prize.
GENERAL CONDITIONS
Verification. Entries are subject to verification by the Contest Organizers. Any Entry Form that is, as the case may be, incomplete, fraudulent, submitted late, or does not include the correct purchase type (if required for the purposes of the Contest) will be automatically rejected and will not entitle the entrant to a prize.
Non-compliant entries. The Contest Organizer reserves the right to disqualify any person or to cancel the entry of any person participating in this Contest or attempting to participate in this Contest by a means that is contrary to these Contest Rules or that is unfair to other entrants (e.g. entries exceeding the permitted limit, automated entries, computer hacking, etc.). In such a situation, the Contest Organizers reserve the right to collect all of the participant's personal information, to use it and to communicate it to the competent police and judicial authorities.
Acceptance of prize. All prizes must be accepted as described in these rules and cannot be transferred to another person, substituted for another prize or exchanged in whole or in part for cash, except as provided in the paragraph dealing with prize substitution.
Prize Substitution. In the event that, for reasons unrelated to a winner, the Contest Organizers are unable to award a prize (or portion thereof) as described in these Contest Rules, they reserve the right to award a prize (or portion thereof) of equal kind and value or, at their sole discretion, the cash value of the prize (or portion thereof) as described in these Contest Rules.
Refusal to accept a prize. Refusal by a randomly selected entrant to accept a prize as described in these Contest Rules releases the Contest Organizers from any and all obligations to that entrant in connection with that prize.
Limitation of liability - use of prize. Each selected entrant releases La Fabrique de Matelas, their affiliates, related companies, divisions and subsidiaries, their advertising and promotional agencies, employees, agents and representatives (collectively the "Releasees") from any and all liability for any damages that he or she may suffer as a result of accepting or using the prize. In order to be declared a winner and prior to receiving his/her prize, each selected entrant agrees to sign, if required, a Declaration Form to this effect.
Warranty. All persons selected for a prize acknowledge that the only warranty applicable to their prize is the normal warranty of the manufacturer, retailer and/or manufacturer of the prize, if applicable. A statement to this effect will be included in the Declaration Form.
Prize Provider's Liability. Any person selected for a prize acknowledges that upon receipt of a letter confirming his/her prize, performance of the services related to that prize becomes the sole and exclusive responsibility of the prize provider. A statement to this effect will be included in the Declaration Form.
Limitation of Liability - Operation of the Contest. The Releasees release, to the fullest extent permitted by law, any and all liability for any computer component, software or communication line malfunctions, or for any transmissions that are faulty, incomplete, incomprehensible or garbled by any computer or network, and which may limit or prevent any person from participating in the Contest. The Releasees also disclaim any and all liability for any damage or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page, software or form and the transmission of any information to enter the Contest.
Modification. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest, in whole or in part, in the event that an event, error or human intervention occurs that could corrupt or affect the administration, security, impartiality or conduct of the Contest as contemplated by these Contest Rules, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, if required. In all cases, the Contest Organizers and their affiliates, related companies, divisions and subsidiaries, their advertising and promotional agencies, suppliers of products or services related to this Contest and their employees, agents and representatives shall not be required to award more prizes than those indicated in these rules or to award prizes other than in accordance with these rules.
Inability to Act - Labor Dispute. The Released Parties will not be liable in any way for any inability to act due to an event or situation beyond their control or due to a strike, lockout or other labor dispute at their place of business or at the places of business of the organizations or companies whose services are used to conduct this Contest.
Limitation of Liability - Participation. By entering or attempting to enter this Contest, each person releases the Releasees from any and all liability to the fullest extent permitted by law for any damages that such person may suffer as a result of participating or attempting to participate in the Contest.
Authorization. By entering this Contest, the winner authorizes the Contest Organizers, their partners and representatives and any person duly authorized by the Contest Organizers, to use, if required, his/her name, photograph, image, prize statement, place of residence, voice and any material submitted in connection with the Contest, without any compensation whatsoever, at their discretion and without any limitation as to the period of use, in any media and on a worldwide scale, for publicity purposes or for any other purpose deemed appropriate.
Communication with Participants. No communication or correspondence will be entered into with entrants in connection with this Contest except with those selected for a prize.
Guest of a minor winner. In the event that the prize also extends to guests and a guest of a winner is a minor, the guardian or a person with parental authority will be required to sign the Declaration Form and accept, if applicable, the prize for and on behalf of the minor.
Decisions of the Contest Organizers. Any decision by the Contest Organizers or their representatives regarding this Contest is final and without appeal, subject to any decision by the Régie des alcools, des courses et des jeux du Québec with respect to any matter within its jurisdiction.
Dispute. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
Participant Identification. For the purposes of these rules, the entrant is the person whose name appears on the Entry Form and it is to this person that the prize will be awarded if selected and declared a winner.
No Affiliation. This Contest is in no way affiliated with, endorsed, presented, sponsored or hosted by Facebook, or any other social media outlet.

Personal Information. The personal information you provide to the Contest Organizer in connection with this Contest is provided by you voluntarily. Personal information collected about entrants in connection with this Contest is used for the administration of this Contest and is subject to the Privacy Policy. No communications, commercial or otherwise, unrelated to this Contest will be sent to the entrant by La Fabrique de Matelas unless otherwise permitted by the entrant, if applicable, by checking the appropriate box on the official entry form or as permitted by the Privacy Policy.
Language. In the event of a discrepancy between the French and English versions of these Rules, the French version shall prevail.
